Software tool only
Carbon Pass helps users organise invoice, shipment, product, HS/CN code, weight and emissions information for CBAM-related review. Carbon Pass does not provide legal, tax, customs, accounting, environmental, carbon verification or regulatory advice.
No official status
Carbon Pass is not an official government, EU, HMRC, customs authority, tax authority, carbon registry, accredited verifier, authorised CBAM declarant or customs broker service. Use of Carbon Pass does not guarantee compliance with EU CBAM, UK CBAM or any other carbon border, customs, tax or environmental requirement.
User responsibility
Users remain solely responsible for checking HS/CN classification, product scope, country of origin, importer/declarant obligations, embedded emissions data, carbon price deductions, supporting evidence, filings, reports and declarations. Any data extracted from invoices, PDFs, spreadsheets or uploaded documents must be reviewed and approved by the user before use.
Human review required
Carbon Pass may use automated extraction, parsing, calculation, mapping and document generation. Automated outputs can contain errors, omissions or outdated assumptions. Users must independently verify all extracted data, calculations and generated filing support packs before relying on them.
No guarantee of accuracy or completeness
Carbon Pass is provided on an “as is” and “as available” basis. We do not warrant that results are accurate, complete, current, suitable for a particular filing, accepted by any authority or sufficient for compliance purposes.
Regulations change
CBAM rules, guidance, scope, certificate prices, default values, reporting formats and implementation dates may change. Users must verify current requirements with the relevant authority or a qualified adviser before submitting any report, declaration or evidence.
Filing support packs are preparation documents
Any filing support pack generated by Carbon Pass is a draft support record only. It is not a certificate, legal opinion, verified emissions statement, customs declaration or official CBAM filing.
Limitation of liability
To the fullest extent permitted by law, Carbon Pass and its operators will not be liable for indirect, consequential or financial losses arising from use of the platform, including penalties, rejected declarations, incorrect classifications, missed deadlines, incorrect emissions values, incorrect certificate exposure estimates, business interruption or loss of profit.
Uploaded documents and data
Users must only upload documents they are authorised to process and share. Users are responsible for ensuring that uploaded documents do not breach confidentiality, data protection, export control, trade compliance or third-party rights.
Confidentiality and security
Carbon Pass is intended to handle commercially sensitive trade documents. A live platform should use secure storage, access controls, encryption in transit and appropriate retention/deletion controls. Users should not upload unnecessary personal data or special category data.
No professional relationship
Use of Carbon Pass does not create a lawyer-client, tax adviser-client, customs broker-client, accountant-client or verifier-client relationship.
Professional advice recommended
Users should seek advice from a qualified customs broker, CBAM consultant, lawyer, tax adviser, accredited verifier or other relevant professional before making decisions or submissions based on Carbon Pass outputs.
Acceptance
By using Carbon Pass, uploading documents or generating an filing support pack, the user confirms that they understand and accept these terms, have reviewed the extracted data, and remain responsible for any use of the output.
